Upholding Standards at the Bar:

Now is the time for Chambers to mandate Anti‑Bullying, Unlawful Harassment & Sexual Harassment Training for their Members & other personnel

The 2025 Harman Review was not a recommendation for reflection - it was a call for immediate profession-wide action.
A new cultural landscape is coming in to force for those who work in and around the Bar:

The Bar Council expects Chambers to confront entrenched hierarchies, end bullying & harassment and drive systemic cultural change.

The Bar Standards Board expects Chambers to take proactive preventative steps - not simply to react to complaints.

Training is not longer optional.  It is an essential part of regulatory risk management

Chambers must act promptly to:
Avoid regulatory exposure by evidencing structured, role-specific training that prevents bullying, unlawful harassment & sexual harassment
Avoid regulatory investigations, formal findings, mandatory undertakings and increased scrutiny of leadership.
Avoid loss of the "all reasonable steps" defence in Employment Tribunals - who will ask:
   - Was training recent?
   - Was it was tailored to the Bar?
   - Did it address third-party harassment?
   - Was it embedded across all relevant roles?
Avoid reputation & recruitment risk - Chambers that fail to respond to the risk of bullying & unlawful harassment risk being perceived as culturally unsafe.

If a complaint of bullying or harassment were made next week, could your Chambers demonstrate decisive preventative action?

If the answer is uncertain ... the time to act is now.

3-in-1 Bar-specific training that provides:

  • Strong evidence of compliance with Bar Council & BSB post-Harman guidance
  • Explicit reference to the BSB Core Duties & Conduct Rules that apply to bullying & harassment
  • Training on 'serious misconduct' reporting obligations
  • Explicit reference to policies on intimate relationships between members/employees and pupils, mini‑pupils, students or others on any type of work experience
  • Strong evidence Chambers/employers have met the current legal obligation to take “reasonable steps” to prevent sexual harassment and avoid enhancement of compensation by up to 25% -  this training also evidences Chambers have taken "all reasonable steps" to prevent unlawful harassment (legal obligation to be introduced soon).
  • Clear explanations of multiple complaints reporting pathways including through internal Chambers processes, "Talk to Spot", the Bar Council, the BSB and the JCIO
  • High quality, consistent training across all categories of learners - regulated Members & Chambers' employees and workers
  • Learning management system dashboard for course completion tracking & certificates
  • 120 minutes of high quality, tax deductible CPD
